1. Scope and provider

These terms govern the use of Veylark (website, dashboard and moderation bot) by streamers (“customer”). The provider is Michael Zimmermann, Obere Vorstadt 1, 78532 Tuttlingen (“we”). Deviating terms of the customer do not apply.

2. Service

Veylark checks chat messages in the customer's Twitch channel against the rules the customer sets and carries out the configured actions (deleting, replying, timeouts, bans). Classification is automated with AI models. It can be wrong: messages may be flagged wrongly or missed. New rules therefore start in test mode, and every action can be reviewed in the moderation log and, where Twitch allows, undone. We do not owe a particular moderation result.

As long as the connection to Twitch chat is not enabled, the service is available in simulation mode; actions are then only carried out in the simulator.

3. Account and requirements

Sign-in uses a Twitch account. The customer must own the connected channel or be authorised to manage it, comply with Twitch's terms of service and be of legal age or act with the consent of a parent or guardian. Access credentials must be kept confidential.

4. Plans, quotas and prices

The scope depends on the chosen plan (number of rules, checked messages per month, timeouts and bans). The “Free” plan is free of charge. Until online payment is introduced, paid plans are only enabled by separate agreement; prices and payment terms are communicated before a plan change. When the monthly quota is used up, the bot does not switch off but only checks the wordlist until the next month.

5. Customer obligations

6. Data protection and processing on behalf

During moderation we process personal data of chat participants on behalf of the customer. The data processing agreement is part of these terms. The privacy policy applies otherwise.

6a. Contributing to improvements (optional)

If the customer switches on “Share feedback to improve detection” in the settings, veylark may store the customer's ratings of moderation decisions (false alarms, missed hits, confirmations) together with the respective message text, the system's assessment and, where applicable, the rule text for its own purposes and use them to improve and test detection. Usernames, user IDs and the channel are not stored; recognisable contact details in the text are removed. The option is voluntary, off by default and can be revoked at any time; revocation applies to future reports.

7. Availability

We strive for uninterrupted operation but do not owe any particular availability. Maintenance and disruptions at Twitch, Cloudflare or the AI models may limit the service. If no model is reachable, the bot does not act.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slight negligence we are liable only for breaches of essential contractual obligations and limited to the typical, foreseeable damage. Liability is otherwise excluded. We are not liable for the consequences of moderation decisions based on the customer's rules.

9. Term and termination

The agreement runs for an indefinite period. The customer can end it at any time by disconnecting the channel under “Exemptions”; all channel data is deleted in the process. We may terminate with two weeks' notice, and without notice for good cause (in particular violations of section 5). For paid plans the terms stated at booking apply.

10. Changes

We may change these terms with effect for the future. The new version is presented for acceptance at the next sign-in; without acceptance the customer may end the agreement.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state of their habitual residence. If the customer is a merchant, the place of jurisdiction is our registered office. Should any provision be invalid, the remaining provisions remain in effect.
